Process Looming on March 31, 2014

Under current law, Medicare payments under the physician fee schedule will be drastically reduced on April 1st and the exceptions process for the outpatient therapy caps will terminate at midnight on March 31st. It is beyond quibble that patients and providers alike will be seriously harmed by these events. It is absolutely critical, therefore, that Congress passes legislation before March 31st to prevent the fee reduction and reauthorize the exceptions process. Marden employees owe it to their patients and to themselves to contact their Members of Congress and encourage them to support immediate action to prevent the cuts and extend the exceptions process.

CONTACTING YOUR SENATORS

* The new Chairman of the Senate Finance Committee, Sen. Ron Wyden (D-OR), recently introduced S. 2110, the Medicare SGR Repeal and Beneficiary Access Improvement Act of 2014. This bill permanently reforms the SGR methodology and repeals the outpatient therapy caps. You should strongly encourage your two Senators to vote for this legislation when it is brought to the floor in the near future.
* If the House and Senate cannot pass legislation to permanently fix the fee schedule and repeal the therapy caps, you should tell your Senators they must pass a short term “patch” before March 31st to ensure Medicare beneficiaries are not deprived of needed rehabilitation services.

CONTACTING YOUR CONGRESSMAN

* On March 14th, the House passed H.R. 2810, the Medicare Patient Access and Quality Improvement Act of 2013, which permanently eliminates the SGR methodology and replaces it with a revised payment system for physicians and other providers. However, this legislation does not repeal the therapy caps nor does it extend the exceptions process.
* You should encourage your Member of Congress to support legislation which permanently reforms the SGR methodology and repeals the therapy caps.
* If the House and Senate cannot pass legislation to permanently fix the fee schedule and repeal the therapy caps, you should tell your Senators they must pass a short term “patch” before March 31st to ensure Medicare beneficiaries are not deprived of needed rehabilitation services.
