Fee Schedule Update – April 1st Deadline Will Not Be Met [03-30-10]

The health care reform bills recently passed by Congress do not include a fix for the physician fee schedule (inclusive of Part B therapy services). Because of its great cost, the Democratic leadership wanted to deal with the issue separately from health care reform.

Pursuant to this separate track, the Temporary Extension Act was passed by Congress several weeks ago which provided that the current payment levels under the physician fee schedule will be in effect until April 1, 2010. In the days immediately preceding its recess for Easter, the Senate attempted, but failed, to pass a House-passed bill which would have extended the fee schedule for another 30 days until the end of April 2010. Congress will not return until April 12th so the 21percent reduction in the fee schedule will go into effect on April 1st. CMS has said that it will do what it can under current law to manage the situation including holding claims submitted after April 1st in anticipation of additional Congressional action.

For now, we just have to wait until Congress returns from their spring break.
